5-Time DUI Offender Charged With DWI at 2.5 Times Legal Limit

Lawrence John Lockhart, 45, faces two driving-while-impaired charges after his breath test allegedly registered a blood-alcohol level 2.5 times the legal limit to drive.

A Rosemount man with five prior DUIs faces two more DWI charges after he allegedly blew a .201 in a preliminary breath test when police stopped his motorcycle this past weekend.

Lawrence John Lockhart, 45, is charged with first-degree driving-while-impaired (under the influence of alcohol with prior felony conviction) and first-degree DWI (over .08 and over .08 within two hours with prior felony conviction), both felonies for which the maximum combined penalty is 14 years in prison and a $28,000 fine.

According to the criminal complaint, a officer was driving behind a motorcycle shortly before 1:30 a.m. Aug. 26, and saw it drift over the fog line and center line multiple times, stop past a stop sign and eventually turn into a driveway.

The officer pulled over the motorcycle, which Lockhart was driving, the complaint says. The officer allegedly smelled alcohol on Lockhart's breath and observed red, bloodshot, watery eyes and slurred speech as Lockhart told the officer he had been at a benefit ride earlier that day.

When asked, Lockhart told the officer he didn't know how much alcohol he had drank earlier, the complaint says.

The officer gave Lockhart three field sobriety tests, according to the complaint: the horizontal gaze test, which allegedly showed Lockhart's eyes did not move smoothly back and forth; and the one-leg stand and walk and turn tests, during which he was unable to balance.

A preliminary breath test showed a blood-alcohol content of .201, 2.5 times the legal limit to drive, the complaint says.

Lockhart was taken to the Rosemount police station at about 1:50 a.m., and attempted to contact an attorney but couldn't reach one. He was given a breath test at 3 a.m. and allegedly registered a .17.
