Rosemount Man Charged with Violating Domestic Assault Protection Order

A Dakota County sheriff's deputy arrested Benjamin Casarez Dakins, riding in the same car with his victim.

A Rosemount man has been charged with violating a domestic assault protection order after police say they arrested him at the end of October, riding in the same car with the victim who sought the order against him.

Benjamin Casarez Dakins, 41, faces a felony charge of violating an order for protection, which carries a maximum penalty of five years in prison and a $10,000 fine.

Dakins remained in the Dakota County Jail Tuesday, Nov. 1 on a $40,000 bond. An omnibus hearing in his case is scheduled for Nov. 14 in Dakota County District Court in Hastings.

According to the criminal complaint, a Dakota County sheriff’s deputy stopped a vehicle on the afternoon of Oct. 25 after noticing that the male passenger wasn’t wearing a seat belt.

The deputy checked the car’s license plate, and determined that the registered owner was the person driving. He also found that the driver had an active protection order against Dakins.

The deputy determined that Dakins was the passenger.

The protection order against Dakins was served in January and remains in effect. It makes it illegal for Dakins to have any contact with the victim.

Dakins was convicted of domestic assault in 2003 and 2004 and violating a no-contact order in 2009.
