Rosemount Woman Charged with Driving Away from Police While Intoxicated

Marianne Wensole-Landivar was charged with a felony, two gross misdemeanors and a misdemeanor following the Sept. 2 incident.

A 33-year-old Rosemount woman was arrested for allegedly driving away from West St. Paul Police while she was legally intoxicated.

Marianne Wensole-Landivar was charged with fleeing a peace officer in a motor vehicle, a felony; third-degree driving while impaired (under the influence of alcohol) and third-degree driving while impaired (0.08 or more within two hours-aggravating factor), both gross misdemeanors; and obstructing legal process, a misdemeanor.

According to the Dakota County complaint:

West St. Paul Police arrived at the scene of a reported fight involving five to seven people on West Bernard Street at about 12:35 a.m. Sept. 2. They began talking to a man in a white car who reportedly was causing problems. The driver of the car, Wensole-Landivar, allegedly got out of the car to approach the area where the man and officers were talking. When officers tried to stop Wensole-Landivar, the man ran away.

Officers reportedly ran after the man through several yards and over fences. The man ran to Bernard Street, where the white car, reportedly driven by Wensole-Landivar, was waiting for him. He got into the car, which sped away.

The police chasing the man called for backup, and one of the squad cars that responded saw a white car pull into a driveway. An officer approached the car, and Wensole-Landivar allegedly got out on the driver’s side and began walking toward the officer. Instead of obeying the officer’s commands to put her hands in the air and get on the ground, Wensole-Landivar reported stood near the vehicle with her hands up and said, “What’s going on?”

Additional officers reportedly arrived and Wensole-Landivar was taken into custody. Police say she was resistant to police commands, and the arresting officer smelled the odor of alcohol on her breath with she spoke.

Wensole-Landivar allegedly failed the preliminary breath test at the scene. She took another test at the West St. Paul Police Department, where she allegedly had a blood alcohol content of .08.

The complaint says Wensole-Landivar was convicted of driving while intoxicated in 2006 in Dakota County.

If convicted on all charges, Wensole-Landivar could face up to three years in jail and up to a $5,000 fine for the felony charge, up to a year in jail and up to a $3,000 fine for each of the gross misdemeanors, and up to 90 days in jail and up to a $1,000 fine for the misdemeanor charge.
