UPDATE: Confusion Leads to Warrant for Apple Valley MMA Fighter

Brett Rogers had been granted a continuance but confusion led to warrant being issued for non-appearance.

UPDATE: 1:15 p.m. - A warrant that was previously issued for Apple Valley fighter Brett Rogers after failing to appear for a scheduled hearing yesterday has been revoked. Roger's Attorney, Murad Mohammed, told Apple Valley Patch that confusion in the court system led to the warrant being issued.

"We were scheduled to appear yesterday but were granted a continuance do to an ongoing trial obligation I have in Washington County," Mohammed said. "I wasn't there, my client wasn't there and the state wasn't there."

Mohammed said his obligation in Washington County neccessitated the continuance and that continuance until Thursday had already been granted. He says the hearing officer on Tuesday morning had not been notified of the conitnuance resulting in an automatic warrant being issued for non-appearance.

That confusion has now been cleared up and the warrant has been revoked.

The hearing will now take place Thursday, Sept. 15 at 8:30 a.m. Apple Valley Patch will report the outcome following the hearing.

A warrant has been issued for Apple Valley MMA fighter Brett Rogers after he apparently failed to appear for a scheduled hearing related to according to the Dakota County District Court case file.

Rogers was charged with third-degree assault, domestic assault by strangulation, having a pattern of stalking conduct—all felonies—and one gross misdemeanor count of endangerment of a child, according to the criminal complaint.

A pre-trial settlement conference had been originally scheduled for Aug. 31 had been rescheduled for Sept. 13. Rogers and his attorney, Murad M. Mohammad of Woodbury office Mohammad & Jaafar-Mohammad, had said at that time that it appeared that Rogers' wife would not testify against him. Mohammad had said that he believed Rogers would not see any jail time stemming from the charges.

Mohammed was contacted about the Sept. 13 scheduled appearance but has yet to comment on the outcome. Rogers wasand conditions that included being present for all future court appearances.

Rogers had a Titan Fighting Championship MMA fight . It’s unclear if that bout will still take place.
